These Terms and Conditions ("Terms") govern your use of the Smart Home Italia website and the purchase of products from our online store. By accessing our website or placing an order, you agree to be bound by these Terms. These Terms are governed by Italian law and the applicable EU consumer protection regulations, including Directive 2011/83/EU on consumer rights.

3. Products and Pricing

All product descriptions and prices are presented as accurately as possible. Prices are displayed in Euros (EUR) and include VAT where applicable. We reserve the right to modify prices at any time without prior notice, but changes will not affect orders already confirmed. In the event of a pricing error, we will contact you before processing the order.

4. Orders and Contract Formation

Placing an order constitutes an offer to purchase. A binding contract is formed only when we send you an order confirmation email. We reserve the right to refuse or cancel any order for reasons including product availability, pricing errors, or suspected fraud.

5. Payment

We accept payment via credit/debit cards, PayPal, bank transfer, and cash on delivery. All payments are processed securely. For credit card payments, your card will be charged at the time of order confirmation. Bank transfers must be completed within 5 business days of order placement.

6. Delivery

We deliver throughout Italy and the European Union. Delivery times are estimates and may vary depending on your location and product availability. Standard delivery within Italy takes 3-5 business days. EU delivery takes 5-10 business days. Risk of loss passes to you upon delivery.

7. Right of Withdrawal

In accordance with EU Directive 2011/83/EU and Italian Consumer Code (D.Lgs. 206/2005), you have the right to withdraw from the contract within 14 days of receiving the goods without giving any reason. To exercise this right, you must inform us of your decision by a clear statement. Please refer to our Return & Refund Policy for detailed instructions.

8. Warranty

All products sold are covered by the legal guarantee of conformity (24 months for consumers) as provided by the Italian Consumer Code. If a product is found to be defective or non-conforming, you are entitled to repair, replacement, price reduction, or contract termination as per applicable law.

9. Limitation of Liability

To the maximum extent permitted by law, Smart Home Italia shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our website or products. Our total liability shall not exceed the amount paid by you for the specific product giving rise to the claim.

10. Intellectual Property

All content on this website, including text, graphics, logos, images, and software, is the property of Smart Home Italia or its content suppliers and is protected by Italian and international copyright laws. Unauthorized reproduction or distribution is prohibited.

11. Governing Law and Jurisdiction

These Terms are governed by Italian law. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the Court of Genova, Italy, unless mandatory consumer protection rules provide otherwise.
